Bembo regulates purchases made on the site bembo.it in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003 regarding electronic commerce.

ARTICLE 1 - Subject of the Contract

Under these general sales conditions, the customer purchases the movable material goods listed and offered for sale on the site www.bembo.it. The contract is concluded exclusively through the internet, via the customer's access to www.bembo.it and the creation of a purchase order according to the procedure provided on the site.

The customer agrees to review and accept these general sales conditions before confirming their order.

ARTICLE 2 - Pre-contractual Information for the Consumer - Art. 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the customer reviews the characteristics of the goods, which are detailed in the individual product sheets at the time of selection. Before finalizing the purchase contract and validating the order with "payment obligation," the customer is informed about:

  • The total price of the goods, including taxes, with details of shipping costs and any other charges;
  • Payment methods;
  • The time frame within which Bembo commits to delivering the goods;
  • Conditions, terms, and procedures for exercising the right of withdrawal (Article 6 of these conditions);
  • Information that the customer will bear the cost of returning the goods in the event of withdrawal;
  • The existence of the legal warranty of conformity for purchased goods;
  • Post-sale assistance conditions and commercial guarantees provided by Bembo.

ARTICLE 3 - Conclusion and Effectiveness of the Contract

The sales contract is considered concluded upon Bembo's sending of an order confirmation email to the customer. The email contains the customer's details and order number, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent. The customer is responsible for verifying the accuracy of the personal data contained in the email and promptly notifying Bembo of any corrections.

Bembo strives to describe and present the items sold on the site as accurately as possible. However, some errors, inaccuracies, or minor differences between the site and the actual product may occur. Additionally, the photographs of the products on www.Bembo.it are only representative and not contractual. For food items such as spices, peppers, and flavored salts, there may be differences in shape and color compared to the photos on www.Bembo.it due to the artisanal nature of the preparations and ingredient variations. The same may apply to other items, such as Himalayan pink salt lamps, and all other handmade and packaged products.

Bembo disclaims any responsibility for discrepancies due to production by the manufacturer or any damages or delays due to transportation.

ARTICLE 4 - Product Availability

Product availability refers to the actual availability at the time the customer places the order. This availability should be considered purely indicative, as products may be sold to other customers before the order confirmation. Even after Bembo has sent the order confirmation email, partial or total unavailability of the goods may occur. In this case, the customer will be promptly informed via email.

If the customer requests the cancellation of the order, terminating the contract, Bembo will refund the amount paid within 14 days from the day Bembo becomes aware of the customer's decision to terminate the contract.

ARTICLE 5 - Payment Methods

All customer payments can only be made using the methods indicated on the dedicated page.

ARTICLE 6 - Prices

All sales prices of products indicated on the site www.bembo.it are expressed in Euros and include VAT. It is not possible to request different packaging from those displayed on www.Bembo.it. Shipping costs are not included in the purchase price but are indicated and calculated at the conclusion of the purchase process before payment.

The customer accepts Bembo's right to change its prices at any time; however, the goods will be invoiced based on the prices indicated on the site at the time of order creation and listed in the confirmation email sent by Bembo to the customer.

In the event of a computer, manual, technical, or any other type of error that results in a substantial change in the retail price, making it exorbitant or clearly unreasonable, the purchase order will be considered invalid and canceled, and the amount paid by the customer will be refunded within 14 days from the cancellation day.

ARTICLE 7 - Right of Withdrawal

The right of withdrawal is exercisable only for non-food items (lamps, copper pots, chef uniforms, etc.). The food nature of the products, even if non-perishable, prevents any verification of safety and hygiene after their return.

In accordance with current legal provisions, the customer has the right to withdraw from the purchase without penalty and without providing a reason, within 14 days from the date of receipt of the products.

The customer who wishes to exercise the right of withdrawal must notify Bembo with a clear declaration, which can be sent via registered mail or through the email address info@bembo.it.

The goods must be returned to Martini S.r.l., Via dei Novaj n. 1, 21010 Cardano al Campo (VA), with shipping costs borne by the customer. All other direct costs of returning the products are the responsibility of the customer. The goods must be returned in perfect condition, in the original packaging, complete with all its parts (including packaging and any documentation and accessories: manuals, cables, etc.), and with the attached fiscal documentation. Subject to verifying compliance with the above, Bembo will refund the amount of the products subject to withdrawal within a maximum of 14 days. As provided by Article 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, Bembo may suspend the refund until the goods are received.

ARTICLE 8 - Legal Warranty of Conformity

In the case of receiving products that are non-conforming or defective, the customer has the right to restore the product's conformity without charge through repair or replacement. The customer can exercise this right if the defect manifests within two years from delivery and reports the defect to Bembo within 2 months from discovery. The customer must report the defects within the established time frame to info@bembo.it.

ARTICLE 9 - Liability

Bembo assumes no responsibility for disruptions caused by force majeure or unforeseen events, including those resulting from malfunctions and disruptions of the internet network, if it fails to execute the order within the contractually agreed time.

ARTICLE 10 - Access to the Site

The customer has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is allowed. The integrity of the elements of this site, whether auditory or visual, and the related technology used remain the property of Bembo and its affiliated group companies and are protected by intellectual property rights.

ARTICLE 11 - Cookies

The website www.Bembo.it uses cookies. Cookies are electronic files that record information related to the customer's browsing of the site (pages viewed, date and time of consultation, etc.) and allow Bembo to offer a personalized service to its customers. Bembo informs the customer of the possibility to disable the creation of such files by accessing their internet configuration menu. However, this will prevent the customer from proceeding with online purchases.

ARTICLE 12 - Completeness

These General Sales Conditions consist of all the clauses they contain. If one or more provisions of these General Sales Conditions are deemed invalid or declared so by law, regulation, or a decision by a competent court, the remaining provisions will continue to be fully effective and enforceable.

ARTICLE 13 - Applicable Law and Jurisdiction

These General Sales Conditions are governed by Italian law. Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the court of the customer's place of residence or domicile, if located within the State. In any case, it is possible to optionally use the mediation procedures under Legislative Decree 28/2010 for the resolution of any disputes arising from the interpretation and execution of these sales conditions.
